Terms of Service

These Terms of Service ("Terms") govern your access to and use of peonypro.com, the Peony App, and all related content, programs, and services (together, the "Services"), operated by Peony PRO, LLC ("Peony," "we," "us," or "our").
By creating an account, applying for membership, enrolling in a program, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that apply to specific programs or features. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements and that all information you provide is accurate and current.
2. Development status and no warranty of content
ALL CONTENT ON THE PEONY PLATFORM IS CONTINUALLY UNDER DEVELOPMENT AND PEONY MAKES NO WARRANTY OF ANY KIND, IMPLIED OR EXPRESS, AS TO ITS ACCURACY, COMPLETENESS, OR APPROPRIATENESS FOR ANY PURPOSE.
3. Educational purposes only
The information provided through the Services is strictly for educational and informational purposes. If you apply ideas contained in the Services, you take full responsibility for your actions.
4. Not medical or health advice
The Services cannot and do not contain medical advice. Health-related information is provided for general educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment from a qualified professional who is aware of the facts and circumstances of an individual situation.
Nothing in the Services should be understood as a recommendation that any person not consult a medical or health professional. Peony expressly recommends seeking the advice of a qualified professional.
Never disregard professional medical advice or delay seeking it because of something encountered in the Services. In an emergency, contact emergency services immediately.
Neither Peony nor any of its employees, owners, contributors, or partners shall be held liable for any errors or omissions in the Services, or for any damage suffered as a result of failing to seek competent medical or health advice from a professional familiar with an individual's situation.
5. Not professional advice, and no professional-client relationship
The information in the Services is not legal, financial, insurance, tax, or other professional advice. While Peony's personnel and contributors are professionals, and the information relates to areas within their professionalism, it is not a substitute for advice from a professional aware of your individual circumstances.
Your use of the Services does not create a professional-client, provider-patient, or fiduciary relationship between you and Peony, or between you and any contributor, member, or partner.
6. Scope of practice
The Peony Care Method™, the Peony Care Plan™, Peony's published Standards of Practice, and the Peony Cancer Companion Certificate describe a non-clinical role.
Nothing in the Services authorizes any person to diagnose a medical condition; interpret diagnostic tests, imaging, pathology, staging, or genomic results; recommend, prescribe, adjust, or discourage any treatment, medication, supplement, diet, or therapy; evaluate whether an intervention is medically appropriate or safe for an individual; deliver clinical or psychotherapeutic treatment; clinically triage or determine the medical severity of symptoms; or hold themselves out as a licensed clinician.
Peony's published standards are Peony's own standards for its program and community. They are not law, licensure, accreditation, or independent personnel certification, and confer none. They carry no statutory, governmental, or national regulatory authority.
You are solely responsible for practicing within your own license, credential, training, and scope, and for complying with all requirements applicable to you in your jurisdiction and setting.
7. Accounts and account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Accounts are personal to you and may not be shared, transferred, or sold. Notify us immediately at support@peonypro.com if you believe your account has been compromised.
8. Membership
Application. Membership is by application. Peony verifies stated credentials and license status and reviews applications for alignment with the Peony Care Method™. Peony may accept or decline any application at its sole discretion. Payment is requested only after an application is approved.
Term and renewal. Membership runs for one year from activation and renews automatically at the then-current annual rate unless you decline renewal before the renewal date. We will notify you in advance of any renewal charge and of any change in rate. You may cancel auto-renewal at any time through your account or by contacting us; cancellation takes effect at the end of the current term.
Fees. Fees are stated at the time of application and are payable in advance. Except where required by law, fees are non-refundable, and no credit is given for unused portions of a membership term.
Accuracy and notification. You are responsible for the accuracy of all information you provide and must notify Peony promptly of any change in your license status, credentials, disciplinary history, or fitness to practice.
Suspension and termination. Peony may suspend or terminate membership where information provided is inaccurate or incomplete, where a license lapses or becomes subject to action, where these Terms or the Standards of Practice are breached, or following a finding under Peony's professional accountability process.
9. Verification and the Peony Directory
What verification means. Peony verifies credentials and license status as represented to us and as available from issuing bodies, licensing boards, and public registries at the time of review.
What verification does not mean. Verification is not an endorsement, a guarantee of competence or quality, a recommendation, a referral, or a warranty of any practitioner's services. Peony does not employ, supervise, direct, or control listed practitioners and is not a party to any relationship formed between a listed practitioner and any person who contacts them. Peony makes no representations, warranties, or guarantees as to, and assumes no responsibility for, the services provided by any listed practitioner.
A listing represents only that the practitioner was a member in good standing at the time the listing was published, and, where indicated, that they hold a Peony certificate.
Your listing. You are responsible for the accuracy of everything in your listing. Listings may be withdrawn where standing lapses, and may be suspended or removed under Peony's professional accountability process.
Directory Spotlight placement is a paid placement product. It confers no verification, credential standing, referral priority, ranking guarantee, or editorial recognition, and is identified as a placement.
Permitted use of the Directory. The Directory is provided for personal and professional reference only. You may not copy, scrape, extract, distribute, resell, republish, or use the Directory or any part of it as a mailing or marketing list, or for any commercial purpose other than seeking or making a referral. Presence in the Directory does not represent any listed practitioner's consent to receive marketing communications.
10. Educational programs and the certificate
Separate agreement controls. Enrollment in the Peony Cancer Companion Certificate Program is governed by a separate enrollment agreement, which controls all financial terms including tuition, fees, payment schedules, cancellation, refunds, and withdrawal. Where these Terms and an executed enrollment agreement differ on those matters, the enrollment agreement controls.
Program policies. Student rights and responsibilities, academic and conduct policies, grievance and appeal procedures, and any state-mandated disclosures are set out in the Peony Student Handbook, which is provided to enrolled students and forms part of the enrollment relationship.
Nature of the credential. The certificate is an educational certificate. It is not licensure, accreditation, independent personnel certification, or authorization to bill any payer. Completion of program requirements is necessary but not sufficient; conferral rests on a documented entrustment decision made against a published standard.
No guarantees. Peony makes no guarantee of employment, income, client volume, registration, apprenticeship placement, reimbursement eligibility, or any subsequent credential.
11. The Peony Care Plan™ and the Peony App
The Peony Care Plan is a personal planning tool owned and controlled by the person who creates it.
It is not a medical treatment plan, clinical record, diagnostic tool, monitoring service, or emergency service. It does not provide medical advice, interpret results, recommend treatment, determine whether a symptom is urgent, replace the medical record, or alert or monitor any healthcare team.
Follow the instructions your healthcare team has given you for symptoms, side effects, concerns, and emergencies. Do not delay seeking medical or emergency care because of anything in a Care Plan or the Peony App.
Peony does not guarantee uninterrupted availability of the Peony App and is not responsible for any consequence of unavailability.
12. Reimbursement and billing
Peony materials may reference the CMS Principal Illness Navigation service codes and related payment policy for reference only.
Nothing in the Services authorizes any person or organization to bill any payer. Billing eligibility, supervision arrangements, consent, documentation, and claim submission are the sole responsibility of the qualified billing entity and are subject to current payer requirements. Peony makes no representation that any service will be covered or reimbursed.
13. Contributor content
Contributions of educational content are governed by a separate Contributing Expert Agreement, which controls scope, terms, compensation where applicable, ownership, permissions, and review rights.
A contributor's participation represents that contributor's own defined educational contribution. It does not imply endorsement of Peony's platform, any other contributor, any sponsor, or any product or service.
14. Views expressed
Views and opinions expressed by contributors, instructors, members, forum participants, and guests are their own and do not necessarily reflect the views of Peony. Peony welcomes respected differences in interpretation and does not require contributors to agree with one another or with every position represented across the ecosystem.
15. Sponsorship, partnership, and disclosure
Peony works with commercial partners and sponsors. Sponsorship funds production and reach; it does not determine content. Commercial relationships are disclosed alongside the content they relate to.
Partnership, catalog inclusion, event sponsorship, and Directory Spotlight placement are not endorsements by Peony, by any contributor, or by any member.
16. Affiliate links
The Services may contain affiliate links, and Peony may earn a commission on purchases made through them. Affiliate relationships do not influence editorial content, protocol contents, or which experts are invited to contribute.
17. Testimonials and results
The Services may contain testimonials from members, students, contributors, and users. These reflect the individual experiences of those people and are not necessarily representative of what any other person will experience. Your results may vary.
Testimonials are reviewed before publication and appear substantially as given, subject to correction of grammar and typographical errors and to shortening for length.
Testimonials are not, and must not be construed as, claims that any Peony product, service, program, framework, or partner product can be used to diagnose, treat, mitigate, cure, or prevent any disease or medical condition. No testimonial has been clinically evaluated.
18. Reviews and third-party references
Peony may provide reviews of or references to products, services, practitioners, organizations, consultants, or experts. Any review represents the good-faith opinion of its author. Products and services reviewed may have been provided to Peony at no cost or at a reduced price.
Any reference is not an endorsement or a statement that information provided by the other party is accurate. It is your responsibility to conduct your own investigation and to make your own determination.
19. External links
The Services may contain links to third-party websites or content. Such external links are not investigated, monitored, or checked for accuracy, adequacy, validity, reliability, availability, or completeness by us. We do not warrant, endorse, guarantee, or assume responsibility for any third-party website or content, and we will not be a party to or responsible for monitoring any transaction between you and any third party.
20. Community features and user conduct
The Services may include forums, case discussion, messaging, comments, and other interactive features. You alone are responsible for the material you post or send.
It is a condition of your use of the Services that you do not:
- Restrict or inhibit any other user from using and enjoying the Services
- Post identifying information about any person in case discussion or any clinical forum. Cases must be discussed without identifying details.
- Impersonate any person or entity, or misrepresent your affiliation, credentials, licensure, or standing
- Post content that is unlawful, defamatory, harassing, discriminatory, threatening, or infringing
- Present clinical advice, treatment recommendations, or diagnostic conclusions as coming from Peony
- Gain unauthorized access to the Services or any connected account, system, or network
- Obtain or attempt to obtain materials or information through means not intentionally made available
- Post or transmit any material containing a virus or other harmful component
- Use the Services to post, transmit, or exploit any material for commercial purposes or containing advertising
- Advertise, solicit, or recruit without our express written approval
- Scrape, harvest, or gather email addresses, listings, or other information posted by other users
Peony may remove content, restrict features, or suspend accounts that violate these conditions. Peony has no obligation to monitor community features but reserves the right to do so.
21. Your content and the license you grant
You retain ownership of content you post. By posting content to the Services, you grant Peony a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the Services.
You represent that you have the right to post the content and that it does not infringe the rights of any third party.
22. Intellectual property
The Services and all materials available through them are the property of Peony and/or its affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws.
Cancer Companion™ is a trademark of Peony. The Peony Care Plan, Peony Care Planning, and the Peony Care Method are proprietary frameworks of Peony, protected by copyright.
Member and student access is a limited, revocable, non-transferable license for your own professional use. It does not permit reproduction, redistribution, resale, sublicensing, public posting, or the use of Peony frameworks, protocols, curriculum, assessment materials, or educational content to develop or deliver competing training or services.

23. Copyright complaints
If you believe content on the Services infringes your copyright, send a notice containing the information required by the Digital Millennium Copyright Act to legal@peonypro.com. We will respond in accordance with applicable law and may remove content and terminate repeat infringers.
24. Personal responsibility
By using the Services, you accept personal responsibility for the results of your actions. You agree to use judgment and conduct due diligence before taking any action or implementing any plan, protocol, or recommendation encountered through the Services.
25. No guarantees
Peony has made no guarantees about the results of taking any action. Peony provides educational and informational resources. Your ultimate success or failure will result from your own efforts, your particular situation, and innumerable other circumstances beyond Peony's control or knowledge.
26. Errors and omissions
The Services are a public resource of general information intended, but not promised or guaranteed, to be correct, complete, and up to date. We have taken reasonable steps to ensure accuracy but cannot represent that the Services are free of errors. You agree to verify any information obtained through the Services before relying on it or taking action.
27. No warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." PEONY MAKES NO WARRANTIES REGARDING THE PERFORMANCE OR OPERATION OF THE SERVICES. PEONY EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, AS TO THE INFORMATION, CONTENT, MATERIALS, DOCUMENTS, PROGRAMS, PRODUCTS, BOOKS, OR SERVICES INCLUDED ON OR THROUGH THE SERVICES.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
28. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PEONY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRIBUTORS, INSTRUCTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF USE, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER OR NOT PEONY HAD NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, PEONY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PEONY IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
29. Indemnification
You agree to indemnify, defend, and hold harmless Peony and its officers, directors, employees, contributors, and agents from any claim, demand, loss, liability, damage, or expense, including reasonable attorneys' fees, arising out of or relating to your use of the Services, your content, your professional practice, your breach of these Terms, or your violation of any law or the rights of any third party.
30. Online commerce
Certain parts of the Services may allow you to purchase products and services provided by third parties. We are not responsible for the quality, accuracy, timeliness, reliability, safety, or any other aspect of those products and services, and any transaction is between you and the third party.
31. Termination
You may stop using the Services at any time. Peony may suspend or terminate your access at any time, with or without notice, for any breach of these Terms or where continued access would create risk to any person or to the integrity of the Services.
On termination, your right to use the Services ends. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.
32. Changes to the Services and to these Terms
We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms; the updated version will be posted here with a revised date, and where changes are material we will provide notice. Continued use after changes take effect constitutes acceptance.
33. Governing law and dispute resolution
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Before filing any claim, you agree to contact us at legal@peonypro.com and attempt to resolve the dispute informally for at least thirty days.
Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Boulder County, Colorado, and you consent to the jurisdiction of those courts. [ARBITRATION AND CLASS-ACTION WAIVER PROVISIONS TO BE CONFIRMED BY COUNSEL AND INSERTED HERE IF ADOPTED.]
34. General
Entire agreement. These Terms, the Privacy Policy, and any additional terms applicable to specific programs constitute the entire agreement between you and Peony regarding the Services.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. Peony may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Peony is not liable for any failure or delay caused by circumstances beyond its reasonable control.
